By accessing or using the Vishin.ai platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not access or use the Service.
Vishin.ai is a voice phishing (vishing) security awareness platform that enables organizations to conduct authorized simulated vishing campaigns against their own employees or with the explicit consent of a target organization. The Service includes scenario authoring, target management, automated outbound voice calls, call recording and transcription, risk analysis, and reporting.
The Service is intended solely for legitimate security awareness testing, training, and assessment purposes. It is not a tool for conducting unauthorized social engineering, fraud, or any form of malicious activity.
To use the Service, you must register an account and provide accurate, complete information about yourself and your organization. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
The organization administrator is responsible for managing user access, ensuring that all users comply with these Terms, and maintaining appropriate internal approvals for conducting vishing campaigns. You must promptly notify us of any unauthorized use of your account.
You agree to use the Service only for authorized security awareness testing. Specifically, you must:

The Service operates on a pay-per-use token billing model. Key billing terms include:
All prices are in US dollars. You are responsible for any applicable taxes. We reserve the right to modify pricing with 30 days' prior notice.
The Service, including its software, user interface, documentation, and branding, is owned by Vishin.ai and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
You retain ownership of all content you upload to the Service, including scenarios you create, target lists, and campaign data. By using the Service, you grant us a limited license to process your content solely to provide the Service to you.
Your data belongs to you. All tenant data is strictly isolated using partition-key-based separation at the database level. No data is shared between organizations. We do not access your data except as necessary to provide the Service, respond to support requests, or comply with legal obligations.
The Service may record and transcribe outbound vishing calls as part of campaign execution. You are solely responsible for ensuring that call recording complies with all applicable laws in the jurisdictions where calls are placed and received, including but not limited to one-party and two-party consent requirements.
Call recordings and transcripts are stored within your tenant's isolated data environment and are accessible only to authorized users within your organization.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISHIN.AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO VISHIN.AI IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Vishin.ai and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any campaign you conduct using the Service, including any claims by individuals who are subjects of your vishing campaigns.
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice. You may terminate your account at any time by contacting support. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our data retention policy.
Sections 6, 10, 11, 12, and 14 shall survive termination of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the federal or state courts located in Delaware, and you consent to the personal jurisdiction of such courts.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
